What's in the best interest of the child? That's the question the court bases its decisions about where and with whom a child lives. In Rhode Island, there are eight factors that must be considered in deciding what is best for a child. The non-custodial parent is usually granted visitation or parenting time. In Rhode Island it is usual for the court to order joint custody. Joint custody refers to the major decisions in a child's life: religion, education, health, and general welfare. These decisions should be made by two parents, whenever possible.

De facto / Psychological Parents' Rights

Our attorneys have been on the cutting edge of a new legal issue called de facto / psychological parent rights. The concept involves the rights of custody and visitation for people such as step parents or partners in same-sex couples who have no biological attachment to a child, but who have a parent-child relationship.

In Rhode Island Child support is based on the income model. The court looks to the gross income of the parents.

If you have experienced a substantial change in circumstances, such as the loss of a job, a remarriage, or an injury, please contact our family law attorneys to discuss a modification of your child support, visitation, and custody arrangements. Until you notify the court, you are responsible for the current order of child support.
